1. What these terms cover
These terms apply to your use of phoenixspeedindustries.com (the "Site") and, unless a signed estimate or work order says otherwise, to the services Phoenix Speed Industries ("PSI," "we," "us") provides. By using the Site or having PSI work on your vehicle, engine, or parts, you agree to these terms.
2. Using the Site
The Site is for general information. We try to keep it accurate, but specifications, pricing, availability, and results described on the Site can change and are not guarantees. The text, photos, videos, logos, and calibration methods shown on the Site belong to PSI or are used with permission; you may not copy or reuse them without our written consent. Do not use the Site to send spam, malicious files, or anything unlawful. We may change or take down any part of the Site at any time.
3. Estimates and quotes
A message sent through the Site is a request for information, not a booking. Estimates are based on what we can see and what you tell us at the time; they are not binding until you approve a work order. Performance work often uncovers additional needs after teardown, inspection, or testing. If that happens, we will tell you what we found and get your approval before doing work outside the approved scope. Prices for parts can change before the order is placed.
4. Payment
Parts are paid for up front, before we order them. Payments for special-order parts are non-refundable once the parts are ordered. Labor is billed when the job is complete and is due before the vehicle or parts are released. Returned payments and chargebacks on completed work are subject to collection, including our costs of collection.
5. Parts
Parts we supply carry only the manufacturer's warranty, if any; PSI does not add a separate parts warranty unless it is stated in writing on your invoice. We will install customer-supplied parts at our discretion, but we do not warranty those parts, their fitment, or their performance, and labor to diagnose, remove, or replace a failed customer-supplied part is billable. Core charges apply to some parts and are refunded when an acceptable core is returned. Removed parts are discarded unless you ask for them before work starts.
6. Performance, racing, and modified vehicles
Modified vehicles, engines, calibrations, and racing parts are used at the customer's own risk. Modifications may void the vehicle manufacturer's warranty, may not be legal for street use where you live, and may affect emissions compliance, including Arizona emissions testing. It is your responsibility to know and comply with the laws that apply to your vehicle and how you use it. Parts and calibrations sold or installed for competition or off-road use are intended for that use only.
More power means more stress on the engine, transmission, drivetrain, brakes, tires, and everything else. PSI is not responsible for the failure of components we did not build or replace, or for failures caused by operating beyond the limits we recommend, lack of maintenance, fuel quality, driver error, damage, or changes made by anyone else after the work leaves our shop.
7. Dyno testing and tuning
Dyno testing and calibration put a vehicle under sustained high load. By scheduling dyno time you authorize this and accept that mechanical failures can occur during testing, especially on engines or components with pre-existing wear, prior modifications, or unknown history. If we see a problem, we stop and contact you. You are responsible for bringing the vehicle in safe, testable condition (sound tires, no fluid leaks, adequate fuel of the agreed grade). Calibration files created by PSI are PSI's intellectual property, licensed to the specific vehicle they were built for; they may not be copied, shared, resold, or transferred to another vehicle without our written permission.
8. Warranty
Most of what we build is for racing and high-performance use, so warranty terms are set job by job. Any warranty PSI offers on its work will be stated in writing on your estimate or invoice after we have discussed the vehicle and its intended use with you. Unless a warranty is expressly stated in writing, none applies. Any written warranty covers only the labor to correct a defect in our workmanship; it does not cover parts (see Section 5), normal wear, racing or competition use, calibrations, customer-supplied parts, or damage from any of the causes listed in Section 6, and our only obligation under it is to correct the work. Except as expressly stated in writing, PSI makes no other warranties, express or implied, including warranties of merchantability or fitness for a particular purpose.
9. Drop-off and pickup
Please remove personal items from your vehicle; PSI is not responsible for items left in it. Your vehicle is kept inside our shop while in our care. Please pick up your vehicle, engine, or parts promptly once we let you know the work is complete.
10. Photos and video
We may photograph or record customer vehicles and our work for our portfolio, the Site, and social media. Tell us in writing before work starts if you do not want your vehicle shown and we will honor that. We do not show license plates or personal information.
11. Limitation of liability
To the fullest extent permitted by law, PSI's total liability for any claim relating to the Site or our services is limited to the amount you paid PSI for the service in question. PSI is not liable for indirect, incidental, or consequential damages, including lost time, loss of use, towing, rental cars, or race entry fees. Nothing in these terms limits liability that cannot be limited under applicable law.
12. Disputes
These terms are governed by the laws of the State of Arizona. If we have a disagreement, contact us first and we will try to resolve it directly. Any dispute that cannot be resolved will be handled in the state or federal courts located in Maricopa County, Arizona.
13. Changes to these terms
We may update these terms from time to time. The current version, with its effective date, is always posted on the Site. Work already under an approved work order is governed by the terms in effect when the work order was approved.
